Is it running a red light if the light turns red while you are in the middle of an intersection?
I just received a red light violation citation in the mail with my picture and stuff, and in it my car was about 2 car lengths into the intersection when the first picture was taken (which is right when the light turns red). So apparently I entered the intersection when the light was amber, and it turned red later. I am wondering whether I should fight it in court or just pay the hefty fine? Any ideas anybody? Thanks.
In the UK you can use the point of no return defense. It is that if you would have attempted to stop for the traffic light it would have either caused an accident or left you in a dangerous situation, ie stopped in the middle of the intersection. You used your common judgment as a competent driver, you passed a government test to prove that, to reduce the risk of an accident or injury to others. Although American police seem to think you should slam on and cause the crash.
